CLEVELAND HEIGHTS CHAPTER 509 DISORDERLY CONDUCT AND PEACE DISTURBANCE 509.03-DISORDERLY CONDUCTLOUD NOISESINTOXICATION

Living in perfect peace and harmony with our neighbors is indeed a dream come true to homeowners.

During the closing period from January 2020 to February 14,2020 I drove/parked in this community at different times of the day and night and it appeared to be a peaceful community.

Tuesday, January 14,2020 between the hours of 9 a.m. and 11:00 a.m. I met with two inspectors and the realtor to perform the home inspection.

Monday, February 10,2020 around 9:30 a.m. to 10:30 a.m. I met the realtor for final inspection.

Tuesday, February 12,2020 around 9:00 a.m. to 10:30 a.m. I met the waterproofing contractor for the basement estimate.

From January 14,2020 through February 13,2020 I visited this neighborhood during the daytime ,at night ,for inspections and during church services and heard no church bells ringing until February 14,2020 around 6:00p.m. and lasted for over a year.

I know for a fact that if I would have heard bells ringing on the hour and every 15 minutes within the hour, I would not have purchased this property.

This is the schedule of bells I heard during the first year of ownership and up until the late fall early winter of 2021.

During church services or events there were no bells ringing. They sometime would play songs with the bells for holidays or other church events.

9:00 a.m. 9 bells plus 3 bells equals 12 bells

10:00 a.m. 10 bells plus 3 bells equals 13 bells

11:00 a.m. 11 bells plus 3 bells equals 14 bells

12:00 a.m. 12 bells plus 3 bells equals 15 bells

1:00 p.m. 1 bell plus 3 bells equals 4 bells

2:00 p.m. 2 bells plus 3 bells equals 5 bells

3:00 p.m. 3 bells plus 3 bells equals 6 bells

4:00 p.m. 4 bells plus 3 bells equals 7 bells

5:00 p.m. 5 bells plus 3 bells equals 8 bells

6:00 p.m. 6 bells plus 3 bells equals 9 bells

7: 00 p.m. 7 bells plus 3 bells equals 10 bells

8:00 p.m. 8 bells plus 3 bells equals 11 bells

9:00 p.m. 9 bells plus 3 bells equals 12 bells

A total of 123 bells in one day is a bit much.

Surely this would be a valid noise complaint to those who live in close proximity of church bells ringing..... but it is not.

Why? A Federal court ruled in favor of church bell ringing, stating you can not prohibit "sound generated in the course of religious expression".

Funny, on July 09,2021 police responded to my property for a noise complaint that was for a religious event. The Officers informed me I was in violation of the city noise ordinance and was asked to turn my music down. I asked if the church could turn down their bells and received no response from the Officers.

Every Friday for two months prior, I played my music on the porch. If my music was disturbing any neighbor, my email address is listed on my website, they could have asked me to turn it down via email.

To send police was not the proper way to handle this matter, unless you are helping the city build a public nuisance neighbor file on me and to see if they could detect any pot smoking since they saw all the smoke from the grill.

The other reason is that one religion trumps another religion in this city.

The police call did not stop me from playing my praise music. Whenever I am outside working or sitting on the porch I use my 15 watt portable pocket speaker.

The purpose of posting this page is for my tax board hearing and for the future owner of this property. This wood frame property is in direct line of the bell house.

The residents who live in close proximity of the mega church should have reduced taxes due to on going noise that can emit without legal recourse.

The question I ponder, why would a mega church need or choose to ring bells on the hour and every 15 minutes?

Also given consideration for the employees/volunteers that work at the church this must be a nerve numbing working conditions over a course of eight hours or a few hours.

Below are links to church bells lawsuits: heads up, I have searched the Internet for church bell lawsuits and all the complaints I read the church prevailed.

As far as lower taxes for this property, the new windows installed leak and are not soundproof. This is a wood frame house with little or no insulation to dampen the sound. Outdoor activities peace is disturbed. I did not hear any bells ringing or could know how loud or the impact of the bells from this property prior to purchase.

This property would not have sold for $232K if those bells were ringing and the colony of groundhogs running a muck on this property.

Hence, this property should have lower taxes due to loud noise permitted by the mega church bells that impact the quality of peace and enjoyment between 9 a.m.-9 p.m..

CHURCH BELLHOUSE LOCATED IN THE 2500 BLOCK OF LEE ROAD

In 2020 they had a description of the bells on their website it has since been removed. I don't know how many bells they have or how far they can be heard.

I do know they are heard loud and clear at 2591 Lee Road when outside and if the windows are open.

Imagine these huge bells ringing on the hour and every 15 minutes

NOISE COMPLAINT

If sounds emitted for religious purpose have no limit, then why are police asking me to turn my music down when it is for religious purpose.
