MORE DELAYS

On March 14,2023 ,the servicer responded ,they denied mortgage fraud and sent a new loan modification that is higher than the original loan, to be executed by March 30,2023.

I responded back to the lender on March 15,2023, that I am not executing any new loans ,kindly proceed with the foreclosure as I am over a year in back due payments.

Lenders have a minimum list of requirements to execute the foreclosure process.

I have met the first, past due in excess of 90 days and second, I denied both loan modifications,keys for cash or willing to sell the property.

There are a few more documents the lender must send to me before they can file their complaint in court.

I am waiting to be served papers to foreclose. It's kind of funny ,I hear stories of homeowners who want to keep their property and the bank do no not hesitate to foreclose on their property.

If you visit Cuyahoga County foreclosure dockets you can randomly pull a case and see how fast foreclosure was executed.

I have asked time and time again to foreclose and they keep finding a new loan modification.

Currently I am under the Pandemic loan protection and this is a VA loan they must exhaust all options.

In hindsight, I wish I never accepted the pandemic deferment because they would have foreclosed within 90 days to six months oppose to the year deferment and added processes of loan modifications.

I don't qualify for any loan modification because the problems still exist that caused the default- MORTGAGE FRAUD!

The same speed that I am responding to the servicer is the same speed I will respond to the foreclosure documents.

The morgtage fraud cannot be filed until after all damages have occured which is the foreclosure. Thankfully there is a 10 year statute of limitaions on mortgage fraud.

I will be relocating out of the state of Ohio as soon as I can turn over this property. Apparently, they are trying to wear me down ,whereby, I vacate the property and they can bring additional damages to the property. That's not going to happen.



CERTIFIED RESPONSE TO BANK FEBRUARY 14,2023

On February 14,2023, I sent the bank a 12 page certified letter apparently my emails and phone calls were not communicated that I do not want this property and I have no intentions of doing any deals with ANYONE.

The bank proposed payment plan is not something I want nor can afford. My property taxes were increased and this will increase the proposed payment plan.

What the bank does not understand, I'm not paying another mortgage payment, this is alleged mortgage

 fraud .

I don't want to save this property. nor do I want to be a part of this community.

This property will be handed back over to the bank and they can deal with the POSI ,taxes and other bull#$@$ that goes along with real estate in Cleveland Heights and Cuyahoga County.


Because I am liable for property damages, I am forced to survive in this subpar raggedy @@@ property.

Sons of beaches (not a typo), are watching me like a hawk, waiting on me to make a move, so they can slide their wicked @@@ in the property to strip it clean or vandalize the property, so I would have to foot the bill.

There will be no crackheads squatting on this property with my name on the deed.

This case should have been filed October 2022.

In my opinion, Cuyahoga County Foreclosure Court, make it easy to file your answer. The court gives you a pregenerated format how to answer each paragraph from the bank's complaint. File within 28 days and mail a copy to the bank's attorney.

As a pro se ,it will not take me 28 days to file an answer. The reason foreclosure takes so long is because they wait until the last day to file their motions and answers.

If the bank would have filed in October 2022, I would be half way though this mess by now.

As soon as I am served it will be posted on the page and maybe these so called investors will stop calling me.

I CANNOT express enough that I DONT WANT TO BE a TAX SLAVE IN CUYAHOGA COUNTY,CLEVELAND HEIGHTS, OHIO.

After three years, I can say ,I would never reccomend anyone to visit,rent or buy property in Cleveland Heights or Cuyahoga County or cities with POSI.

I am in utter disbelief how and why so many people are drinking this poison POSI like water.

Whenever your VA loan goes into default, the lender notifies the VA of the status. The VA will notify the veteran via letter and assign a loan technician to work with the veteran, to save the property or sell the property.

On January 17,2023, I spoke to the VA loan technician to discuss my status and inform them of the entire "mortgage fraud".

Per the VA, foreclosure is the last option and has the most devastion to a veteran's entitlement and credit score.

If possible they would rather have a deed in lieu or short sale.

There are a few things going on in the background.

As stated, I could give a flying flip about my credit or helping investors.

Yet,buyers continue calling/texting me.

A lender wanting to unload a hornet's nest.

The VA need to close the pending claim.

The veteran want to move on.

The default is growing with every month.

Also note, that with a VA loan, a lender can file a claim for the foreclosure up to 25% of the loan,in my case that is $58K, hence, they allow the default to grow knowing they can file a claim and sell the property for much less to their "chosen" buyer.

If the lender files a claim and it is paid. I will have to pay the VA back before getting reinstated.

IT'S THE BANK'S MOVE

On January 6, 2023, I submitted my correspondence to the bank. The ball is in their court.

Ultimatley,this property will be handed back over to the bank and I will vacate the property by the date set by the court.

Unlike other people, I can't leave this property vacant ,due to trespassers,possible vandals/theft and upkeep of the property to avoid city fines.

Because of the unknown escrow that the city would have demanded and the fact the property is in dire need of repairs my only option was foreclosure.

Foreclosure is a truamatic situation even more so, when it was caused by others who allegedly,knowingly, inflicted great financial hardship by failing to disclose pertinent information and subpar remodeling/repairs performed.

In my opinion,the reason similar acts will continue is due to select enforcement ,lack of legal reprenstation and denied housing discrimination claims.

The population of People of Color are partly to blame, as they choose to allow this bullcrap to continue without taking a stand.

When I asked someone who lost their home in Cleveland Heights , why they did not post something on YouTube or build a website to warn others,their answer was,"no one warned me."

This person owned their property for a number of years and decided to sell their property, due to excessive taxes, they were hit with an excessive escrow and repair list. They could not pay the escrow and make the repairs because the contractors bids were more than the escrow.

They were forced to give their property to an investor, who flipped the property shortly afterwards, making a fat profit.

Jenna and Jeremiah Johnson made the biggest profit in eight months compared to the former owners Hansen and Jenks combined who owned the property for decades.

How? POSI POWER.

After foreclosure, I may have to file bankruptcy.

There is no doubt I will be homeless. I choose not to pay rent to a landlord. I would rather stay with a family member, who own their own property and pay them rent until my credit is restored.

For this and many other reasons this #@#@@## POSI needs to be banned.

ITS OFFICIAL IM PACKING UP TO MOVE OUT


On January 03,2023 the local Home Depot delivered my moving boxes to the back porch of 2585 Lee Road @ 7:37 a.m..

I noticed when I placed the garbage out on the curb ,my boxes were left on the back porch of 2585 all day.

Video showed a hooded delivery driver unloading the boxes from the rear driveway .

Per the online Home Depot agent someone called the local store to say their was an incorrect delivery. Funny ,no one called me.

I quickly removed my boxes only to notice that one bundle, seal was broken and boxes were removed.

Home Depot gave me a full refund and a substantial discount for a new order that was deliverd by Fed Ex to my front steps on January 5,2023. Normally, Fed Ex place my packages on the porch.

I guess this is what they do when you order moving boxes, alert the neighbors that you are moving.

Really people?

Keep watching this property , keep watching me and soon I will be gone. It's my prayer to be gone from this wicked situation this year. I will be here until I get my court order to vacate.

Make my monthly payments or do a loan modification to reduce payments ,deed in lieu or foreclosure.

Loan modification takes about 30 days to decide on a new payment, possibly a 40 year loan and possibly a 1% increase on the rate. Afterwards a 3 month probation period to make payments.

If all goes well, advance to making regular payments.

For the record, a deed in lieu will be on your credit report for 4 years and foreclosure is 7 years.

A deed in lieu is setting a date, 30-60 days to vacate the property and there maybe an option cash for keys.

No court, the lender want the property in resale condition. A local realtor will be assigned to work with the lender in prepping property for sale.

Foreclosure, if the two options above don't pan out, the lender can file a demand letter for late payments and start the foreclosure process, this involves the court, it may take 4 months to two years to process this matter in court.

Foreclosure stays on your report from the first missed payment that led to foreclosure.

Contact the credit bureaus to confirm this information.

To future owners of this property get a petition to demolish this property down to the ground remove all those dangerous dead tress in the rear and along the property lines to includes the leaking roof, exterior siding, dry rot is painted over as a cover up, electrical and plumbing are jacked up.

Install a concrete fence for the animal hoarders in close proximity and to block internet interruption and sound waves.

Rebuild a brick house with a patio with soundproof windows for the church bells that can ring on the hour and every 15 minutes.

Most of all, avoid this community unless they have removed the POSI! Only those with POSI power should own ,rent and sell this property.

ZILLOW Tripping

I have seen this trend with Zillow whenever they assume I'm about to sell ,for example I'm cleaning up my yard they drop the Zestimate . Prime example . FYI Agents fuel Zillow information and can impact the price by what they say to Zillow.

To all those in my business ,you will know the exact date I will be vacating it will be a public document in foreclosure court and posted on this website. Church bells ringing, wildlife and trespassers will not make me move before my time.

Many investors contacted me to buy the property, their creative property flipping was not in agreement with me and sounded like mortgage fraud or a set up to send me to prison.

As stated, I would rather go through foreclosure than deal with a Point of Sale Inspection from the city of Cleveland Heights.

History on this property have shown substantial increase with each POSI.

Having to post an unknown escrow, make repairs for someone else to enjoy and deal with inflated contract work, is not an option for me.

This is the only option to exit the property and return it back to the bank, to clear my name and document this matter in a court of law.

I am a victim of alleged mortgage fraud and other on going crimes in the city of Cleveland Heights, Ohio.

JUNE 05,2022 -DELAYED PROPERTY TAX HEARING


The increased unjust taxes has forced my mortgage up by over $200 a month for an alleged mortgage fraud. The former owners Jenks property tax hearing was a year and six months before they had a hearing. They prevailed because they sold the property for $100K days before their hearing.

The taxes must be paid while waiting on a hearing. This creates the perfect storm for foreclosure.

There is no guarantee my taxes will be reduced at the initial hearing or an appeal.
