After 28 years on the force, and 100 years in the history of Cleveland Heights,the city created a position for an Officer ,who should be planning his retirement.

This action after 100 years says a lot about this city. This POSI may be here for 100 years until they say, they were wrong or this city is reduced to abandoned houses like East Cleveland.

If the Mayor want to make real history and help all residents in Cleveland Heights ,ban this POSI.

Grow this city, oppose to holding property owners in bondage with this POSI.

Wow, Landlords can retain legal representaion for a $100 fee being unconstitutional.

People losing their home costing hundreds of thousands with an unjust POSI and Landlords have a hundred dollar fee issue this law firm chooses the lesser. They removed the POSI from other cities that should be their primary goal to remove all the POSI in Ohio.

CLEVELAND HEIGHTS LANDLORD FINED $3000 OVER

MONTH LONG LACK OF HEAT FOR 40 APARTMENTS.

What are the chances that some of the tenants were People of Color, on Section 8 rent?

A landlord extracts pain and suffering to 40 families, in the dead of winter. and is fined $3000, chances are it was probably cheaper than his heating bill.

This opens doors for more slumlords to do this type of bull crap knowing their fine will be $3000.

I'm almost certain the slumlord received his section 8 stipens on time.

In my opinion, Cleveland Heights housing penalties favors slumlords and shady investors. Violate the POSI a $1000 fine /6 months in jail, which may not be enforced depending on who was violated .

When will Lee Road get more than paint? For the past three years the only thing I have seen on Lee Road is re-painting the lines. A major street that is in dire need of repaving,bike lanes and widening for safety.

Really, a pizza oven. I think homeowners are not allowed to partake in backyard events in Cleveland Heights. This neighbor on Grandview Avenue has filed a 17 page complaint about a pizza oven fumes.

There is a need for PEOPLE to control their nieghbors peace and enjoyment.

I pray the pizza oven homeowner prevail , countersue and bankrupt their @@@ and force them to sell their house. Really People.

MOORE'S RESIGNATION

Former City Coucilmember Josie Moore resignation was accepted December 28,2022. I know what I say have no clout, because of who I am and being a transplant. Kindly read between the lines of this article. I printed a copy in case it is removed from the Internet.

The citizens of Cleveland Heights need to wake up,watch city council meetings, monitor their tax dollars, ban this POSI and elect new officials that are working to build a better city for all residents and treat people equally and fairly.

I sent an email to all city council members and it appeared my email was blocked. I then used another email address and received no response. This is tacky business.

I am sounding the alarm so people can make better buying choices. If you don't have POSI power you should look to relocate if you want to own property.

A HIGHER POWER will deal with all this bullcrap in due time.

FYI: I'm not here to run for any political office here or anywhere.

If you are "Black",own property in one of these POSI cities this is your wake up call . I did not know it was this bad. Based on the data this beast is growing to more cities.

People, this is an outrage as I stated, where there is the highest concentration of People of Color, their most valuable asset, has a stronghold attached to an unjust ordinance. requiring restrictions that will not reap but rather rob homeowners of their equity and generational wealth.

This is a sad state of affairs WAKE the FLIP UP PEOPLE this is an outrage!

In my opionion ,this is a form of blatatnt housing discrimination the transfer of property is not the same as most cities in Ohio.

What this boils down to is that "Black" folks have to ask the city can they sell their property and in return the city requires, often, uneccessary excessive costly repairs.

The homeowner must not only make the repairs in a set time frame but also place equal escrow with the city.

If they choose they can sell(give away) their property to someone with deep pockets, to complete the task list and place the escrow with the city.

Who makes the money? Based on my experience with contractors, in Cleveland Heights, their quotes are inflated because contractors assume you are making repairs for an inspection,that is required.

If a homeowner cannot make the repairs and pay the escrow and choose not to give their property away the city can place a lien on the property.

In my opinion,based on speaking with current and former homeowners ,they stay because they could not afford to pay POSI and they have invested a lot in their house.

If a homeowner changes their mind not to sell their property, the escrow must be paid and the repairs made or face a lien on the property by the city.

In 2019, Jenks, fomer owner of 2591 Lee Road lost $20K after they requested a POSI that required over $40K in repairs. They waited a few months and gave the property away to investors for $100K,who failed to disclose the POSI to me and made $132K for subpar rehab. What a racket?

No one was persecuted for violating the city ordinance and the city denied me a waiver for the inspection. I would be subjected to another bullcrap inspection, if I wanted to sell.

I have chosen to go through foreclosure than deal with this bullcrap.

Other homeowners that I have spoken to had similar results they either gave the property away to save their credit and get from under the POSI or made the repairs and did not make a dime at the closing table, most of them held out for almost 10-12 months waiting on a buyer.

Per the homeowners, they could not afford to vacate the propertyin order to sell it ,hence, they had a constant stream of potential buyers running in and out of their home, often making low ball offers.

Another pattern that I have seen is that the property will decrease several times before it is sold.

I say again, No one would have paid $232K for this property, if the POSI was disclosed and the inspectors inspectected the property fairly.

Failure to disclose pertinet information about a property is motgage fraud.

Why no lawyer in Ohio took my case and others who had similar situations. Ohio morgtage fraud laws charges five to 30 years in prison fines,restitution and the victims are People of Color.

One law that was passed by former President Obama was the extention of morage fraud statute of limtations to ten years.

In my opinion, is why Cleveland Heights could not find enough evidence to procesute anyone for violating the POSI ordinace ,even though they had no record on file for a clearance letter.

For this reason, both realtor boards claimed that Jenna Johnson and Tanesha Speed did not violate any Realtor ethics code.

For this reason, the Title company denied my claim stating I signed a "hold harmless waiver.

Per a lawyer, Hold harmless does not include intential acts.

In my opinion, those in authority denied my claims to weaken my case for mortgage fraud.

Because most victims do not know the statute of limitations on mortgage fraud, they allow the matter to run it's course to expire and no one is convicted or ever filed in court.

It's a crying shame when I cantacted many, many lawyers in Ohio and they stated quickly I don't have a claim or they have a conflict of intrest some of them stated to me that I should go on and forget about this matter because this case is to difficult and have a slim chance of prevailing in Ohio court. They even stated that other clients with a similar case have lost tens of thousands in legal fees.

Stay alert for changes on Lee Road, to 25 miles per hour,change is coming. There is a list in the article but it seems the speed reductions are in the populated areas of People of Color. Parts of Noble,parts of North and South Taylor and Euclid Heights, If you want saftey make the whole city 25 mpg or invest in speed cameras.

In 2020, when the property was on the market the highest cash offer was $100K now two years later the offers are going down to $50K to $70K.

This is a postcard sent to me with a $#$@#$% offer.

Who is going to pay the balance of the loan?

They don't want the property to go through foreclosure because they would have to pay more, it opens up to more bidders and it becomes a public record.

I'm not attorney but this looks like mortgage fraud-failure to transfer per the city ordinance-failure to disclose pertinent information about the property, repairs and infestation , inflated price and unable to sell the property without having ANOTHER POSI!.

Because the city of Cleveland Heights choose who they will enforce the POSI ordinance, homeowners will continue to be robbed blind of generational wealth.

This is a racket!!!!

BEWARE OF BUYING PROPERTY IN POSI COMMUNITIES!!!!!





The postcard shows the hedges that was once home to a colony of groundhogs and everybody on this block knew this property had an infestation of groundhogs.

IT NEVER WOULD HAVE SOLD FOR $232K ,FOR THIS REASON IT WAS SOLD IN THE WINTER DURING HIBERNATION SEASON!

I closed on February 14,2020,weeks later, March 2020 this property was covered with groundhogs, running up the driveway, on the sidewalk up to the front door, in the back yard.

After cleaning the property exterior the animal hoarder(s) is/are training and releasing groundhogs and other wildlife back on the property. What a racket?

This is a well planned operation with those with POSI POWER and those that do not have POSI POWER. BAN THE POSI!!!!!!!

IT'S A CRYING SHAME HOW CERTAIN PEOPLE OF THIS COMMUNITY ARE TREATED BY THE CITY LEADERSHIP.

To the City Leadership, Realtor Boards and Employees in the Housing Inspection Office, it is a crying shame how you allow certain Sellers to get away with allegedly robbing homeowners out of hundreds of thousands of dollars.

This is directed to all those who knew or were made aware that I did not sign/receive an acknowledgement form prior to purchase and knew there was no clearance letter on file for 2591 Lee Road between January 7,2020 and February 14,2020 during closing.

How is it possible that a title company and seller can allegedly skip required steps in the transfer of property in Cleveland Heights without persecution?

How is it possible that no attorney will accept a case that clearly has overwhelming evidence, that the required steps were not taken in transfer of property per Cleveland Heights Chapter 1329 City ordinance?

How is it possible that the city attorney does not have sufficient evidence to persecute those who violated the city ordinance, when there was no clearance letter on file from the city of Cleveland Heights to the title company to transfer 2591 Lee Road nor a signed acknowledgement prior to purchase on file ?

How is it possible that the Realtors were not found guilty of unethical acts in accordance to the National Association of Realtors Ethics Code?

In my educated opinion and experience with this beast of a POS, to few of a people are making a grip off the backs of homeowners and it is a small circle of POWER that profit from the POSI, passed down from generation to generation since 1977.

They don't care that the population hasn't grown since 1977.

Buy in and can't sell or rent, your option is to give away your property or allow foreclosure to take it's course. That is the cycle that I have witnessed and others have shared with me, that are former and current residents.

If you choose to stay prepare for a tax fight and become a tax slave .

The POS Inspection was ruled unconstitutional, why haven't the Governor stopped these cities?

In my opinion, because the POSI adversely impacts those who cannot afford a DREAM TEAM of legal representation.

Why haven't the homeowners took a stand?

Homeowners are in fear of retaliation ,loss of jobs and their business.

What a shady city cycle, a property had a buyer for $121K,after the POSI, the buyer aborted the sale, the sellers waited months, sold to an investor for $100K, who performed subpar work, sold it without a POSI acknowledgement for $232K in under eight months and the current owner can't sell it for $232K,with two years, major clean up on the property and low inventory, investors are offering me $50K-$70K cash, what a racket?

The city of Cleveland Heights chose not to enforce the POSI ordinance and CHOSE to enforce a sign ordinance. The city of Cleveland Heights chose not to give me a waiver of the POSI so that I can sell or have my loan assumed.

Change the name from Cleveland Heights to SHADY HEIGHTS!

Generational wealth is being lost by the millions, It only takes four quarter of a million dollar properties to rack up a million dollars.

Do the math. How much blood ,sweat and equity has been stolen with a slide of the pen and lack of enforcement .

How do you sleep at night?

I will do the next potential buyers a favor by disclosing all the problems and needed repairs, so that future buyers will not get taken by the fresh paint, glossy photos, lack of a POSI and a home warranty that isn't worth the dime.

In my years on this earth, I have never seen something like this beast of a dunghill, go on so long and when it is ruled unconstitutional, it continues on. What a rack of dung.

I will continue praying for all those living under this stronghold.

That's fine and dandy to make new ordinances that includes a minority population. If the Mayor is seeking inclusiveness remove an obsolete ordinance that is causing more pain and loss of profit which is the Point of Sale Inspection.

At a blink of an eye new ordinances are put into place yet an obsolete ordinance remains on the books and never spoken about for removal.

The POSI impacts all property owners which includes the gay population, the focus should be on removing the POSI .

If the housing inspectors were focusing on blights property values would increase. Having blights and unkempt properties impacts the city as a whole for health and wealth.

The POSI is the biggest divider in this city, the have and the have not of POSI POWER. The lack or selective enforcement, hefty escrows and repair costs makes this city less attractive to buyers.

The city will not budge for an ordinance that has been ruled as UNCONSTITUTIONAL.

Be a real hero to the people and put this on your docket to have removed.

Greetings Cleveland Heights City Leadership,

If in fact, you are really seeking to change this city, remove this curse of the Point of Sale Inspection(POSI) from the city, that was set in motion by former leaders, who allegedly wanted some form of control over the buying/selling of property in the early 1970's.

Forty five years later, the population is stagnated and decreased, the city is in dire need of funding and among one of the highest taxed areas.

The city needs population growth to generate revenue for the city from local businesses and through home sales.

This ordinance has been tried for 45 years and it's not working for the better of a prosperous community, nor is it fair or equal to all property owners.

There are currently 20-22 cities in the state of Ohio holding on to this curse.

Why continue with a city ordinance that has been ruled by the Supreme Court as UNCONSTITUTIONAL ?

Why continue with the city ordinance that has caused a decrease in population for over 45 years?

This POSI has been unjust to myself and other alike by not enforcing the city ordinance to those who violate the ordinance.

People are held hostage in the city of Cleveland Heights for fear of the POSI, so they pay the excessive taxes and try to maintain their properties.

A homeowner should have the right to sell their home, if they no longer want to live in Cleveland Heights, taxes are to high or they no longer can afford to maintain a property.

The POSI hold homeowners as hostages, whereby, they are forced to live in a place to avoid losing their equity/home and damaging their credit.

If the POSI were to be removed homeowners could sell their homes, this will allow those who want to pay higher taxes to move in Cleveland Heights.

Chances are the new buyers will be affluent and can afford to make the necessary repairs to keep these century old castles in the community.

The current method of maintaining theses properties is not working. No guarantee or warranty for repairs, sub par work, inflated prices for services and select enforcement for violators.

The city of Cleveland Heights have taxed the people to death and cannot afford to hire police.

By removing the POSI, the population will increase creating more revenues for police and other infrastructures.

Currently the City Housing Inspectors have more power than the Mayor, City Council and Governor combined because homeowners are at the mercy of what they scribble out for escrow/repairs.

Currently on Zillow, as of May 22,2022, there are 50 homes for sale in the peak season. That is sad and not a sign that residents are happy to stay ,its the opposite ,the fear of how much the POSI will demand.

As City Leadership you should want people living in your city that want to live here and will pay the cost for better schools and all the good life has to offer.

The POSI impacts homeowners, businesses and investors who choose NOT to purchase in this city and deal with the POSI. The city is missing opportunities because of this POSI.

If you want to make an immediate change for the better, remove the POSI for population growth and because it has been ruled unconstitutional.

By removing the POSI homes will appreciate in value and become a highly desired place to live. The average homeowner do not want their most valued asset tied to a POSI.

To have homeowners living in fear of the POSI is an unjust city. Homeowners cannot sell their homes, so they opt for the lesser of the two evils and pay the high property taxes or deal with shady investors with creative solutions.

Homeowners want to move with their equity, they rightfully have earned in the property but the POSI ensures that most homeowners will have to pay a hefty escrow and make repairs that will deplete their equity.

I am a victim of an alleged mortgage fraud, I was sold a property in this city without full disclosure of the POSI and the city failed to prosecute anyone.

I am one of many homeowners who have been a victim to this POSI. Most homeowners will not say anything for fear of retaliation at their job and within the community.

In my own defense, I would rather go into foreclosure than deal with the unknowns of the POSI. I choose not to pay for a POSI knowing that I do not want to make any more repairs, it is unconstitutional or give the city the opportunity to have a lien placed on the property for failure to post escrow or repair violations.

Former Mayor and City Council member Alan Rapoport from 1980-1987 thinks there should be no POSI.

The biggest and best thing Cleveland Heights can do for the city is remove themselves from the POSI list.

The time is now to make the most impact in this city and turn it around. The POSI has drained the citizens long enough,45 years and counting!!!!!!!
